Got tagged tonight on my commute home.

We don't get much rain in SoCal, but when it comes it doesn't mess around, and CA drivers are totally clueless in the rain. Riding through the downpour (in my oh-so-stylish, improvised, trash-bag raingear.) on the way home tonight, only about 10 minutes from home, I smacked into a car that pulled out in front of me.

I was in the right-hand portion of the lane on a pretty busy 4-lane street and he was at a stop sign on a small cross street. I had my headlight on my handlebars, but he claimed he didn't see me and pulled out right in front of me. I didn't have time to brake, and in this case I think the fact that I was on a fixie (front brake equipped) was actually to my advantage. Had I been on a freewheeled bike I don't even think I would've had time to get to the brakes, and probably would have hit the carsquare-on at a lot higher rate of speed, doing more damage to my bike (totalled front wheel and fork at the very least, very possibly frame damage as well). As it was I saw him start to go and instinctively beckpedaled and went into skid, unfortunately there wasn't enough space to stop, but I did manage to scrub off a lot of speed before I came into contact with the car. I was sideways and impacted the car with my handlebar, right shoulder, and hand. Busted the driver-side window and got a few small cuts on my arm, but mostly bruising in my shoulder from the impact with the car. After hitting I bounced off and fell over to my left.

Surprisingly enough the guy actually stopped, as did another couple who were very helpful. They got his and my info and exchanged that for me, and also gave me a ride home.. As far as I can tell there's very little damage to my bike other then a possibly bent handlebar, and a scratch on the left chainstay where I fell over.

Should I report this? Being that I was technically "hurt" I probably shouldn't even have left the scene w/o calling cops, but I was freezing my a** off and just wanted to get home to a hot shower and a handful of ibuprofen.

I just want the guy to pay for my new handlebars (if, in fact, they're bent, I've yet to inspect them, closely. They could just appear bent because the dummy-hood twisted on the bar.) and a new light. I had a $30 LED light on there and the bars were nothing terribly fancy (Ritchey Biomax Pro) so he's probably looking at less than $100.

What's the best way to handle this? Should I call the guy and try to do the nice thing and give him a chance to pay without getting insurance involved, or simply contact his insurance company?

Give him a week tops and then do what you need to do to get your bike back to riding form. He failed to yeild and if his insurance found out it'd be more expensive, so I think he'd want to settle under the table. Good luck.

I had a near miss this morning on my way to work about 1 minute into my commute. I had a green and this guy blew through the intersection running the red. Put my bike sideways and yelled, "red light a**hole!" as he swerved to miss me. Soooooo close, his right side mirror missed my bars by about 6 inches. Literally a split second later and I would have been lined up with the center of his grill and soon after just a stain on the road for about a hundred feet! That'll wake you up in the morning. All I got was a wave from the passenger saying sorry, driver never saw me.

...shoulders can be tricky. If you're just sore & abrased & will get over it in a day or 2 give the guy a call & let him know your damage estimate & see how he wants to handle it.

If you're stiff & hurting & you think it may be someting more serious, file an accident report w/ the cops & see a Dr. Even if it goes no further at least you're CYA.

Inspect your bike really well:
- stem (probably OK)
- steerer tube (probably OK)
- bars (bent or not, don't take a chance w/them)
- helmet (you might have impacted that car w/it)

Congrats on surviving the incident, that could be any one of us. You might want to send the nice people that gave you a ride home some flowers or something...

I got tagged in the fall, and sustained some good injuries and some good bike damage, so let me offer this bit of advice: wait.

Yeah if the guy calls you can be cool and ask for a quick check or something, but in all honesty you need to be sure of your injuries, and that's not a quick process all the time. I crashed hard in a race and afterwards rode 11 miles home, but as soon as the adrenaline went away, I was off the bike for almost a week due to soreness and road rash.

I think the statute of limitations in filing a claim in Cali is 2 years, so be patient.

Best of luck to you, and congrats for using the headlight - too bad he didn't see it.

Well, the insurance question has been resolved, he already reported it to his insurance company, and I got a call from them today. He must have wanted his window fixed.

You're right about the statute for an injury claim being 2 years. I'm feeling a bit sore today, but so far no sign of any major trauma, and there's really no road-rash to speak of 'cause I didn't slide anywhere. Basically just bounced off his car and fell in the road beside it. I've got some really minor scratches on my arm, and my shoulder is still a bit sore, but overall I think I got pretty lucky.

I'll give the bike a good once-over this weekend and take pictures of anything that's bent/cracked/broken for the insurance claim.
