Okay here's the deal. I've exhausted all options already since i bought the bike on jan 25 07. Auction number 250074978880

Simply said, the seller said that the bike was FULL dura ace and that everything in the picture is included in the bike.

Unfortunately, after receiving the bike, the bike was not as described. Seller mentioned that it was in great condition. There was a LOT of oxidation which was okay because i cleaned it up anyway. But never again will i buy a bike from florida. The bike was a mess.
So many spots to repaint and all.

in any case, i found out that the
1) BB was not DA after all. it was 105 .
2) The bottle cages were not included (mind you these were ciussi alloy cages which i was trying to get for my other bike)

I emailed the guy if he could send the parts and I'll send what I have back. He says no. I asked him for partial refund. He said no because he "can't" for no apparent reason. I was like wtf. He then said that he would refund everything if i send the bike back. Yeah... right. I paid 60$ in shipping charges here. Sending the bike back isnt' worth it as i'll be out another 60 plus the fact that I want to keep the bike (this is my trash race bike). So we argued and argued to the point where i called and he slammed the phone on me when he heard my name.

I brought this up to paypal. Paypal denied my claim without telling me why.
I claimed again and i got denied for no reason.
I brought this up to ebay. In the case notes, they charge a 25$ fee for investigating and they also require an objective assessment of values. I looked at these assessors charge 50 bucks per case!

No way am i paying that amount to get what a DA BB and 2 ciussi cages are worth. So i'm stuck now and the only thing i can think of to get back what is rightfully mine is to do a chargeback through my CC company. Problem is i dont want to complain about the whole amount, just a fraction of it.

Can anyone suggest what to do?

tell paypal you are considering the chargeback, and then do it... you're getting F'ed over... you didn't get what was represented in the auction... do an ebay claim and leave negative feedback.. F'ers like that are ruining ebay

edit- hold on... just read the description and unless it was changed it seems fair... there is mention of 'quite a bit of wear' and paint bubbling and oxidation. and there is no mention of the cages or 'everything in the picture' being included, so seller may be in the right here. as far as the bb goes I don't think it's a huge deal. looks to be a reseller, so they prob didn't check and just said what the owner told them. lesson- gotta ask questions before, even if they seem stupid and basic... and assume the worst. now if you have emails or answers saying the cages were included you might have something for a claim...

i did ask that question. problem is he replied through my private mail and not through ebay! i have logs of it in my sent folder. I sent it to paypal but they still didnt take that into consideration.

the bubbling and oxidation is an accepted deal, but i never expected the seller to downplay it so much.

yeah it seems that as a reseller, they have no idea about bikes....

Just eat it, dude. It's the cost difference between a used 9-speed 105 BB, and a used 9-speed D/A BB, plus 2 bottle cages (elite's or knockoffs) ...

If I were you, I would be a bit grumpy, but there isn't much you can do in any case, except leave a negative feedback.

I am sure the seller had no idea the BB wasn't D/A, but he is being a jerk for not giving you 20 bucks back or something. Putting bottle cages on for the auction, and not including them, is pretty crappy, too.

But, for buying a full bike from eBay, especially a few year old C'dale, if you got the bike without any dents and generally in good working order, you are luckier than many.

sounds like a serious overreaction on your part. On a used bike, the BB would probably be something I'd replace anyway. Cages? Jeez, just pick up a couple out of the clearance bin at Performance and go for a ride. Seriously, I wonder why people stress so much over things like this. Is it worth all the hassle? Life is short--spend it on the bike, not quibbling.

I've got to agree with the rest in that it sounds like you got exactly what you bid on. The cages were not listed or described in the auction and unless you specifically asked about them in your question to the seller I would just let it go. The DA bb is a high (by todays standard) maintainance item. It needs at least yearly adjusting and greasing. Many bikes that came full DA came with Ultegra or 105 bbs because of this. I bought a used bike that came with DA bb and it was in such bad shape that I had to toss it. I don't think it had ever been maintained before.

well if money was a big deal like for me (college guy) you'd be pissed if you didnt get what you paid for.

That's probably the best thing to do. If I understand the UCC correctly, you could reject the item entirely, as the seller indicated. Or could demand the difference in value between the item as described (including images) and as received. What are the value of the cages and the difference in value between trashed DA and working 105 BB? $5?

I would think being a student that you'd have more important things to concentrate on!

For future reference, study the UCC and use that as a basis for relationships with dealers, negotiating any other terms ahead of time.

I understand where you're coming from. Sometimes I get stuck on the princple of the deal. It wasn't what he claimed it to be.

At this point, its probably gone as far as it can.

It's been said before, a DA BB is not worth the trouble. It needs regular attention. The 105BB though not a DA BB will be better in the long run.

The slamming of the phone down would drive me crazy. But I'd just walk away from this and go ride the bike. Hopefully you saved some money buying it used.

Leave neutral feedback. Except for the cages, it sounds fairly well represented. The seller specifically mentions bubbling and oxidation. He also states it would make a good beater or rain bike. I also doubt the seller knew about the BB. The cages are definately implied as being part of the auction, they are in all the pictures and they are attached to the bike. They aren't listed, but neither is a disclaimer, "cages not included." I forget the timeframe, but it's something like 45 days from auction end to file a claim. Otherwise it's automatically denied.

Realistically, most people would replace the BB anyway, that doesn't make it right, but it was probably an honest mistake. That just leaves the cages.
If it's really worth the hassle, tell your CC co what's missing and the value of replacing it. They may or may not do a partial chargeback.

Me, at this point I'd just let it go and move on. And like I said, I'd probably only leave neutral feedback. If you think it was intentional, leave negative.

EDIT: I just noticed you decided to eat it. Good call, not really worth the aggravation. Now, go ride...:)

This is why I was hesitant to **sell** my used bike on Ebay. Some people expect used to be like new despite descriptions otherwise (not saying the OP did this and the guy was being a bit jerky about the cages). My biggest fear is I'm going to get some email saying, "the chain is worn by 1/1000th of an inch, why didn't you tell me?"

I also think you are over reacting a bit. However, I just bought a Bianchi that had a matching celeste Ciusse cage pictured & was POed that the seller didn't include it in the package. When I emailed him about it he just blew it off. Oh, well, I got a fine bike & had fun finding 2 celeste cages on Ebay in CF. The BB would be NBD to me if I got all the DA stuff on a nice bike. The frame condition would have bugged me the most. Most of my Ebay bike purchases have been A-OK & I have bought like 10.

PM me your name and address, I will send you a set of those bottle cages for free. I have a set that are about a year old that I had on my previous bike I just replaced. I got some carbon ones when I got the new frame. I do not need the stainless ones, they are yours for the asking.
