OK Forum --- Crime and Punishment Or Kids will be kids?

I post - you decide. Off Scott-free or "see you in court son"?

PS - take a break from Donald Trump forum ...
I am 100% convinced the internet and social media are not the salvation to human civility.

If I were those kids' father I'd beat them within an inch of their pathetic lives
Whenever the legislators endeavour to take away and destroy the property of the people, or to reduce them to slavery under arbitrary power, they put themselves into a state of war with the people who are thereupon absolved from any further obedience, and are left to the common refuge which God hath provided for all men against force and violence - John Locke

Good thing there is a stand your ground law that saves lives in Florida, maybe a state law maker could introduce a law named after the victim. As for the kids, i think they are feeling like sh!t now.

Thing is...it sounds like the guy wanted to off himself. So, as disgusting as the kids behavior is...if the guy was wanting to end his life, then maybe the kids actions wouldn't be illegal anyway.

How can that be an extenuating circumstance when they didn't know his intent?

Is failure to rend aid to a drowning person illegal? Immoral, certainly, but is it illegal?

Extenuating to what? What was the crime they committed?

The behavior of the minors here, we all agree, was abhorrent...but what was illegal-if this was a suicide?

There are depraved indifference laws in areas of the USA....however, is it still depraved indifference if the person was trying to off themselves? Hence my query to kiwisimon.

Other then a violation of the chief tenet of all religious-based ethics, i.e., the universal law of reciprocation (the Golden Rule), I am not aware of a legal statue to pursue against these on-lookers.

However publishing the names and photographs of the children on-lookers and all their family members in reporting the story might have some merit.

According to the news report, it isn't.

It may not apply here as the pieces of $hit did not do anything to create the risk of injury.

Depraved indifference focuses on the risk created by the defendantís conduct, not the injuries actually resulting.
I think kiwismom has the best idea. If there is no law, create one. The kids had a cell phone, all they needed to do is call 911.

But it IS illegal not to report a dead body.

Therefore, yes, they committed a crime.

Well then, they should be charged. Never thought of that one.

The way I swim, I would never attempt to save anyone by going into the water. Now if there was a boat or rope or flying shoes, that would be different.

Calling 911 is ridiculus to save him, he would still drown.

    zero chance if you don't

    This.

It's one thing to try and fail. Calling for help, trying to save him themselves, etc.

They didn't do that. These kids mocked a man while he was dying. I suppose that is their 1A right.

I hope they are punished to the fullest extent of any and all applicable laws.
